1. What this agreement covers
These Terms of Service ("Terms") govern your use of the strackt platform and website operated by Madonie Holding, registered in the Netherlands ("strackt," "we," "us," "our").
By creating an account or using the strackt platform, you agree to these Terms. If you do not agree, do not use the service.
These Terms should be read together with our Privacy Policy.
2. What strackt does
strackt is a managed server platform. You connect your own server (a VPS from any provider you choose), add your application, and strackt handles deployment, maintenance, security updates, configuration enforcement, and recovery.
We manage your server while you are a strackt customer. We do not own your server, your data, or your application. You do.
3. Your account
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old or the age of legal majority in your jurisdiction to use strackt.
4. Beta status
strackt is currently in beta.
During the beta period, we cannot make any guarantees regarding service availability, uptime, or reliability. We try our best — but we make no promises. Features may change, break, or be removed. The platform may experience downtime without prior notice.
By using strackt during beta, you accept that the service is provided on an "as is" and "as available" basis without any service level agreement (SLA).
We will clearly communicate when strackt exits beta. At that point, updated terms — including any SLA commitments — will be published and you will be notified.
5. Your server, your data
This is the part we feel strongest about.
Your server is yours. You choose your hosting provider, your region, and your configuration. strackt connects to your server to manage it on your behalf — but ownership never transfers to us.
Your data is yours. We do not access, copy, or claim any rights to the data stored on your server or in your applications. We access your server only to perform the management tasks you have authorized: deployments, updates, security patches, and configuration enforcement.
You can leave at any time. If you cancel your subscription, we sever the connection. strackt includes a detach option that cleanly removes our access from your server. Your server continues to run. Your data stays in place. Nothing is deleted, locked, or held hostage.
We will never intervene with the content or applications running on your server. We will never touch your server or your data after you leave.
6. The Merchant of Record
All payments for strackt are processed by Paddle.com, our Merchant of Record. This means:
- Paddle is the entity that charges you. Your payment relationship is with Paddle, not directly with strackt.
- Paddle handles billing, invoicing, sales tax, VAT, and payment compliance on our behalf.
- Paddle's Terms of Service and Privacy Policy apply to the payment transaction.
- We do not store your credit card or payment details. Paddle does.
Pricing & billing
strackt charges a per-application subscription fee. Pricing is published on our pricing page. We may change pricing with 30 days' notice. Price changes do not apply retroactively to your current billing cycle.
Refunds
Since Paddle is the Merchant of Record, refund requests are handled in accordance with Paddle's refund policies. If you believe you are owed a refund, contact us at [email protected] and we will work with Paddle to resolve it.
Cancellation
You can cancel your subscription at any time from your strackt dashboard. Cancellation takes effect at the end of your current billing cycle. After cancellation, you can detach your server and continue running it independently.
7. Acceptable use
Your server is your server. What you run on it is your business and your responsibility. We do not monitor, police, or intervene with the content or applications on your server.
That said, you may not use the strackt platform itself to:
- Host, distribute, or facilitate content that is illegal under Dutch or EU law.
- Resell, sublicense, or provide strackt access to third parties as your own service.
- Attempt to compromise, reverse-engineer, or interfere with the strackt platform or its infrastructure.
If your use of the strackt platform violates these terms, we reserve the right to revoke your strackt subscription. Revoking your subscription means we stop managing your server and remove our access — we do not intervene with anything running on your server itself. Your server, your data, and your applications remain yours.
8. Intellectual property
The strackt platform, website, brand, and all related materials are the intellectual property of Madonie Holding. You may not copy, modify, or redistribute any part of the platform without our written permission.
You retain all rights to your own code, data, and applications. strackt claims no ownership over anything on your server.
9. Limitation of liability
To the maximum extent permitted by Dutch law:
What we are not liable for
- Indirect or consequential damages — including but not limited to lost profits, lost revenue, lost data, business interruption, or reputational damage arising from your use of strackt.
- Your server content — we do not control what you run on your server. We are not liable for any damages resulting from your applications, data, or content.
- Third-party services — we are not liable for actions, outages, or failures of your VPS provider, Paddle, or any other third party.
- Force majeure — events beyond our reasonable control, including natural disasters, war, government action, or widespread internet failures.
Liability cap
Our total aggregate liability for any and all claims arising from or related to your use of strackt is limited to the fees you have paid to strackt in the 12 months preceding the claim.
Beta liability cap
During the beta period, our total aggregate liability is further limited to the lesser of (a) fees paid to strackt in the 12 months preceding the claim, or (b) EUR 100.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
10. Warranty disclaimer
strackt is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
11. Termination
By you
You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle. You can then detach your server to remove strackt's access entirely.
By us
We may terminate or suspend your access to strackt if you violate these Terms. In the case of a violation, we will make reasonable efforts to notify you before or at the time of termination.
What happens after termination
- We stop managing your server.
- We remove our access from your server (or you can do so yourself via the detach option).
- Your server continues to run with its last known configuration.
- Your data, applications, and server remain yours.
- We delete your strackt account data within 30 days, unless retention is required by law.
12. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice on the platform at least 30 days before the changes take effect.
Your continued use of strackt after the changes take effect constitutes acceptance. If you do not agree with the new terms, you may cancel your subscription and detach your server.
13. Governing law & disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of strackt will be submitted to the competent courts in the Netherlands.
If you are a consumer in the EU, this does not affect any mandatory consumer protection rights available to you under the laws of your country of residence.
